Terms of Use

These Terms of Use constitute an agreement between you and Crates when you purchase or use any Crates products or services. By clicking ‘I agree’ when prompted, or by accessing our websites or apps, you acknowledge that you have read and agree to these Terms.
We reserve the right, at any time, to modify the Site and/or the terms of this Agreement. We recommend that you check these terms periodically to see if there have been any modifications. Modifications that we deem crucial will become effective fifteen (15) days upon being posted on the Site. Your continued use of the Services after modifications are posted will be considered an acceptance of the modified terms.
This website is owned and operated by Crates IKE, a private limited company duly registered in the Business Registry (B.R. no. 140235307000), operating under Greek law.

In these Terms, the following meanings have been applied:

Definitions

‘Crates Website’ means the website https://crates.app/ provided to you by Crates IKE as accessed by any application or device.
‘Product’ means any downloadable product or any service that is made available to you through the Crates Website.
‘Service’ means the Crates Website and any product, feature, service or application that requires a Crates Account to access.
‘Order’ means your offer to Purchase or download for free any Product from Crates.
‘Crates Software’ means any downloadable software, product, service, plugin, extension or upgrade product provided by Crates.
‘Product Plan’ means any of the product plans offered by Crates for Crates Software on the Crates Website.
‘Third Party Content’ means any content that is owned, licensed or controlled by an independent third party that is posted to, or accessed from, a Crates Service.
‘Third Party Software’ means any software owned by third parties that may be installed as part of installing Crates Software or separately.
‘Referral Link’ means a unique URL generated for a registered user to invite new users under Crates’ referral program.
‘CRT tokens’ means internal reward points or credits without monetary value, granted by Crates under specific conditions.

Your Crates Account

In order to create a Crates account or simply use our services you must be of the minimum age the applicable law requires in order for Crates to provide you with the Services without parental consent (including using your personal data).
You agree to ensure that your Crates Account information is true and up to date at all times, including personal and contact information as well as all billing and payment information. You are solely responsible for maintaining the confidentiality of your log-in information, and you agree to immediately notify Crates using the methods described at the Contact Us section of any suspected unauthorised use of your Crates Account.
You may not use your account to breach the security of another account or attempt to gain unauthorised access to another network or server. You may not decompile, reverse engineer or otherwise modify the source code, unless it’s permitted by EU law related to the interoperability of the software.
Users who violate systems or network security may incur criminal or civil liability.
You agree that we may at any time, and at our sole discretion, terminate your account without prior notice to you and without reimbursement if we suspect a violation of any of these Terms of Use.
In addition, you acknowledge that we will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in investigating suspected criminal violations.
All information we obtain about you in connection with your use of the Website and/or our apps is subject to our Privacy Policy, which is incorporated by reference into these Terms of Use.

Referral Program Integrity
Users agree not to create multiple accounts, impersonate others, or otherwise attempt to obtain referral benefits through false, deceptive, or misleading means. Violations may result in account suspension or termination and forfeiture of CRT tokens or other rewards.

Ordering a Crates Product

In order to place an Order for a Product you will be required to create a Crates Account if you do not already have one. This will require that you provide us with certain personal information. You can always refer our Privacy Policy for information on how Crates uses your personal data.

Choosing Your Version

You can choose between the Free Plan and the Supporter Plan. If you have acquired the free version, you may upgrade it any time to a paid Supporter Plan by logging into your Crates Account and changing your product plan. If you have purchased a Supporter Plan you may also upgrade your current version to another major Supporter version, if available, through your Crates Account.

Availability of Products

The availability of Crates Products, Website, or Services may vary depending on your location or other factors. We reserve the right, in our sole discretion, to restrict their availability including for certain countries, regions or jurisdictions and to modify, update or discontinue them (including renewals) at any time.
Subject to these Terms of Use, we will supply you with the Product Plan and the Software indicated on your Order.
In case you have ordered one of the Supporter Plans, we will supply you with the ordered product after we have received the full payment through the payment method you have selected in your Order.

Pricing

The price of the ordered product will be shown in your Order depending on the Product Plan you have chosen.
Crates reserves the right to change the prices for Products displayed on the Crates Website at any time.
The price of your ordered product does not include VAT if applicable. We reserve the right to update and amend the pricing based on any changes to the relevant local tax, effective from the date that the change takes effect.

Payments

You may pay for your Product by using one of the methods of payment as displayed in the payment section on the Crates Website.
All online card transactions are secured and processed by a third party processing provider. Except for your name and contact details, payment card data are processed by our payment processor and are not stored by Crates.
Depending on your location, some transactions might require foreign currency conversion or be processed in another country. Your bank might charge you additional fees for those services when you use a credit or debit card. Please contact your bank for details.
You agree to provide true, accurate, current and complete account information and to maintain and promptly update your Crates Account and information, so that we can complete your transactions and contact you as needed in connection with your Order.

Referral Program 

Crates may offer a voluntary referral program (i.e ‘Tell a friend’) that allows existing users (‘Referrers’) to invite others (‘Referees’) to create an account or become Supporters.
When a Referee visits the Crates Website through a referral link, a temporary session value will store the Referrer ID. If the Referee signs up during the same browser session, the account will be marked as referred by the corresponding user.
Referrers may view, through their account panel, how many invited users have joined and how many have become Supporters.
Eligible referrals may generate non-monetary credits (‘CRT tokens’) or other in-app rewards, as determined by Crates. CRT tokens have no cash value, are not transferable or redeemable for money, and may be used only for features, merchandise, discounts, or other benefits defined within the Crates ecosystem.
Self-referrals and the creation of multiple accounts by the same person or entity to obtain referral benefits are prohibited. Crates reserves the right to verify eligibility and to reject, suspend, or revoke rewards or tokens in cases of suspected fraud, self-referral, or misuse of the program.
The referral program is offered worldwide and may be modified, suspended, or discontinued at any time without notice, and without liability for accrued or unredeemed tokens or benefits.
Participation in the referral program does not establish any employment, partnership, agency, or franchise relationship between you and Crates.

Returns – Refunds

We provide a refund if we receive a plausible reason (e.g. the software was not supported by the user’s computer, despite compliance with the minimum System Requirements) within five (5) days of purchasing the product. You can always try the free version of the Product before purchasing a Supporter Plan.

Privacy

Our use of your personal data when you set up a Crates account or place an order is governed by our Privacy Policy. The types of personal data collected, the methods of collection and processing, the legal bases of the processing, the reasons of the processing and other important information can be found described in detail in our Privacy Policy which we recommend that you read carefully since it is inextricable part of these Terms, which means that by accepting them you are also accepting our Privacy Policy.

No warranty

Our services are provided on an “as is” and “as available” basis without warranties of any kind whether express or implied. We also reserve the right to change, suspend or discontinue any of the services at any time and at our sole discretion. We will not be liable to you for the effect that any changes, delays or interruptions to the services may have on you, including your income or your ability to generate revenue through our services.
Crates makes no warranty or representation and disclaims all responsibility and liability for:
(i) the completeness, accuracy, availability, timeliness, security or reliability of the services or any content;
(ii) any harm to your computer system, loss of data, or other harm that results from your access to or use of the services or any content, expressly excluded the loss or damage the user suffers that is foreseeable result of breaking the End Users Licence Agreement (EULA).
(iii) the deletion of, or the failure to store or to transmit, any content and other communications maintained by the services; and
(iv) whether the services will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
No advice or information, whether oral or written, obtained from Crates or through our services, will create any warranty or representation not expressly made herein.

Software Licensing

All Products, regardless of the product plan they belong to, are licensed to you in accordance with these Terms as well as the applicable EULA. You will be asked to agree to the terms of the applicable EULA at the time you install the Crates Software.
All rights, title and interest in respect of the intellectual property rights in the Crates Software remain with Crates and its applicable licensors at all times.

Crates copyright and trademark

Our trademarks, brand identity, logos, graphics and everything that distinguishes our services is protected by the intellectual property laws of the European Union and the national legislation. You do not own any of our marks and indicators thus you cannot modify them or use similar logos, graphics, words etc as yours and according to the specific relationship you have established with Crates depending on how you use our services.
You may not use any of our names, logos, designs, indicators, trademarks etc in an unlawful, misleading, defamatory way or in any way that is objectionable to us.

Third Party Content and links

Our Site may include links to other sites on the Internet, or be accessed from other sites on the Internet, that are owned and operated by online merchants and other third parties, and which may contain references to information, software, materials, products, and/or services
provided by the third party.

These third party sites may contain information which some people consider inappropriate or offensive. You acknowledge that these third party sites are beyond our control, and we are not responsible for the availability of, or the content located on or through, any third-party site.
You should contact the site administrator or webmaster for third-party sites if you have any concerns regarding such links or the content located on such sites. We do not endorse nor assume any liability for the third party websites, services, or products.
If you would like to notify us of content which you believe does not comply with these Terms of Use, please contact us directly. Make sure to include a screenshot or Uniform Resource Locator (“URL”) for the non-complying content, and the reasons you believe it does not comply. You understand that in using THIS SITE, you may be exposed to materials that are objectionable. You hereby waive all rights, claims, and actions in law or equity against Crates arising from your exposure to such materials.

YouTube API Services

Crates includes features that use YouTube API Services. By using these features, you also agree to be bound by the YouTube Terms of Service.

Miscellaneous

These Terms of Use will take effect as a contract made under, and be governed by Greek and European Union law. You submit to the non-exclusive jurisdiction of courts of Athens, Greece.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
